The copyright is strict, but justified. In a request to use a license such as Creative Commons, McKusick replied:

I prefer that the BSD Daemon be used in the context of BSD software. That is the reason that I carefully control my copyright of the BSD Daemon image to ensure that the image is not used inappropriately. I have agreed to allow the small image to appear on Wikipedia but not the larger ones. It is also why I am not going to put a creative commons copyright on it.

For non-free fair use in FreeBSD and BSD Daemon: Acceptable use of this image of the BSD daemon is claimed under two rationales documented at Wikipedia:Non-free content#Images. #2, Team and corporate logos: For identification as a former logo of FreeBSD and current official mascot of the project and moreover, the widely noted mascot of BSD operating systems generally and publicly limited to such use by the copyright holder, in an article or section of an article which discusses the character in the image along with its history, along with #8, Images with iconic status or historical importance: As a subject of commentary in an article or section of an article directly related to BSD operating systems which is dedicated to the character depicted in the image. Since the daemon character itself is copyrighted, no free alternative is available.

This is a logo of an organization, item, or event, and is protected by copyright. It is believed that the use of low-resolution images on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, of logos for certain uses involving identification and critical commentary may qualify as fair use under the Copyright law of the United States. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. Certain commercial use of this image may also be trademark infringement.
