To be hosted on Commons files must be in the public domain in the source country and the U.S. A work is in the public domain in India under the conditions described at [[:commons:Template:PD-India|Template:PD-India]], which comes from the The Indian Copyright Act 1957, Chapter 5, Section 25. Indian works are also considered to be in the public domain in the United States under certain conditions, see [[:commons:Template:PD-1996|Template:PD-1996]]. In other words, anonymous works, photographs, cinematographic works, sound recordings, government works, and works of corporate authorship or of international organizations published only in India before 1936 can certainly be considered to be public domain in the U.S. also. However, the Indian copyright that is used for this calculation actually had a copyright extension in 1991 from 50 to 60 years to protect the rights of Rabindranath Tagore, so works whose copyright had expired in India prior to December 31, 1991 are also public domain in the U.S., which includes certain works published before January 1, 1941 and other works where the author died before January 1, 1941.
